In Texas, if you are over 21 and are found to have a blood alcohol concentration (BAC) over .08 percent. The only people who can be charged with a DUI in Texas are minors under the age of 21, in which case they can be given a DUI if any alcohol or illicit substance is detected in their system while driving.
